The continual battle between Samsung and Apple has been quite the story, stretching three continents and several different countries, each having their own slightly different outcome. As we know, the battle down under in Australia was won by Apple, but now takes a turn for the under dog. Samsung quickly appealed the initial injunction against their Galaxy Tab 10.1 and it looks like the new judge has sided with them.

The Sydney Morning Hearld has announced that the initial injunction has been lifted off the sales of the Samsung Galaxy Tab 10.1 in Australia. Apple has appealed this (of course they have) and put forth a request to impose the injunction till this Friday at 4:00 pm in order for Apple to prepare for the appeal. The Federal Court honoured Apple’s request, so 4:01 pm in Australia technically Samsung can sell their awesome tablets! One of the stipulations with the lifting of the ban is that Samsung will keep track of all transaction involving the device in Australia. I have a feeling they were going to anyways…

While this is a great win for Samsung, there still will be a full hearing on copycat accusations in March 2012, which could still result in a permanent injunction against the sale of the tablet. Samsung has yet to announce any details on the availibility of the tablet in Australia, but we do expect them shortly.
